Nona Adventure Park Season Passholder Terms and Conditions

SEASON PASSHOLDER TERMS AND CONDITIONS

This Agreement (“Agreement”) is entered into by and between Nona Adventure Park (“Park”) and the individual purchaser (“Passholder”), collectively referred to as the “Parties.” By purchasing and/or using a season pass, Passholder agrees to the following terms and conditions:

1. Term of Agreement

a. This Agreement shall commence on the date of purchase of the season pass and remain valid for the designated membership term as specified on the pass.

2. Nature of Membership

a. Membership is non-exclusive and does not grant any private access, rights, or privileges beyond those explicitly stated in the offer at the time of purchase.

b. Membership is prepaid, meaning all fees are paid in advance and are non-refundable except as explicitly defined in this Agreement.

3. Passholder Rights and Benefits

a. Passholders are entitled to the rights and benefits as defined in the specific offer under which the pass was purchased.

b. These benefits may include, but are not limited to:

i. Access to Park facilities during regular operating hours, subject to capacity limitations.

ii. Discounts, perks, or promotions explicitly listed in the offer.

iii. Additional rights or privileges specified at the time of purchase.

c. The Park reserves the right to adjust or modify the rights and benefits for future offers, but the benefits for current passholders will remain as outlined in their original purchase terms for the duration of the membership.

d. Passholders do not receive priority access over retail customers unless explicitly stated writing at time of purchase.

e. Perks and benefits may be subject to availability and do not guarantee preferential treatment.

4. Membership Usage

a. Passholders must check in at the designated location each time they visit the Park.

b. Passholders must present their valid membership pass for entry and applicable discounts.

c. Passes are non-transferable and can only be used by the individual named on the pass.

d. Misuse or fraudulent activity will result in immediate termination without refund.

e. Lost or stolen passes must be reported immediately. Replacement passes may incur a fee.

f. Some activities, programs, or time slots may require advance reservations, as determined by Nona Adventure Park.

g. Blackout dates may apply during peak periods, special events, holidays, private bookings, or full or partial park buyouts, as determined by Nona Adventure Park.

h. From time to time, the park or portions of the park may be unavailable to members due to private events, corporate functions, or exclusive park buyouts.

i. Membership does not guarantee access to specific attractions, programs, dates, or times.

j. All access is subject to capacity limits, safety considerations, and operational discretion.

5. Park Rules and Behavior

a. Passholders must adhere to all posted safety instructions and Park policies.

b. Passholders are responsible for the conduct of their guests, including but not limited to those visiting with a Buddy Pass benefit.

c. Any Passholder who consistently violates rules or behaves in a manner inconsistent with the Park’s values may have their membership terminated without refund.

d. Fraudulent submission of waivers, including forging signatures or misrepresenting legal guardianship, will result in immediate expulsion from the Park without refund.

e. Members are expected to act as ambassadors of Nona Adventure Park and to conduct themselves in a manner consistent with the values, standards, and reputation of the park.

f. Members and their guests must behave in a safe, respectful, and lawful manner at all times and comply with park rules, posted signage, and instructions from park staff.

g. Any conduct that, in the sole discretion of Nona Adventure Park, undermines, harms, or attempts to malign the park, its staff, its guests, or its reputation may result in suspension or termination of membership privileges without refund.

h. Access to the Park will be suspended until a valid waiver is submitted.

6. Park Operations, Closures, and Capacity Management

a. The Park reserves the right to adjust operating hours, including temporary closures, due to weather, safety, maintenance, or business conditions.

b. Passholders will be notified of significant changes via email or other communication methods.

c. Closures will not result in refunds or extensions to membership terms.

d. Operating hours include capacity management; during peak periods, the Park may implement restrictions to ensure a safe and enjoyable experience for all guests.

e. Passholder entry is subject to availability and does not guarantee immediate access during high-capacity periods.

f. The benefit of “Unlimited” access to attractions, including but not limited to the Aqua Park, Climbing Tower, and Wake Nona, is determined solely by capacity and operational constraints.

g. “Unlimited” does not include every calendar date, and is subject to the operational calendar, which is also subject to change.

7. Payment and Refund Policy

a. Finality of Payments: All payments made for memberships, passes, or any Park-related services are final, except as expressly stated in Section 10 of this Agreement.

b. No refunds, credits, or exchanges will be provided for unused time, missed days, or failure to utilize memberships or passes.

c. Any exceptions to this policy will be explicitly noted in the terms of a specific promotion or agreement.

8. Assumption of Risk and Waiver Requirement

a. All members must have a valid and current waiver on file to access the Park and its activities.

b. For minors, waivers must be completed and signed by a legal guardian.

c. Fraudulent submission of waivers will result in immediate expulsion from the Park without refund.

d. Access to the Park will be suspended until a valid waiver is submitted.

e. Passholders acknowledge that participation in activities at the Park involves inherent risks, and they voluntarily assume these risks.

f. The Park does not supervise minors, legal guardians are responsible at all times.

9. Membership Modifications

a. The Park reserves the right to alter membership benefits, terms, or pricing for future renewals.

b. Existing members will retain their current pricing until the end of their membership term unless notified otherwise.

10. Refunds and Cancellations

a. Passes are non-refundable except as specified below:

i. Within 30 days of purchase (if unused).

ii. Signup fees are non-refundable under any circumstances.

b. Passholders may cancel their membership at any time, but no refunds will be issued for unused time or intra-month cancellations.

c. No refunds, credits, or extensions will be provided for closures, reduced operating hours, weather conditions, mechanical issues, maintenance, force majeure events, special events, private bookings, or a member’s inability to attend or participate, except as required by law.

11. Buddy Pass Benefits

a. The "One-Time Buddy" Rule: Each unique guest is permitted to use a Buddy Pass only once per calendar year, regardless of which member invited them.

b. Buddy Pass benefits are subject to membership tier and must be specified in writing at time of offer to be valid, unless otherwise stated by Nona Adventure Park.

c. Depending on the membership type and/or date purchased, the date Buddy Pass benefits reset may vary, and is subject to the jurisdiction of Nona Adventure Park.

d. All Buddy Pass benefits are subject to the jurisdiction of Nona Adventure Park, and may be terminated at any time due to misuse or fraudulent activity.

e. Misuse of Buddy Pass benefits will result in termination of membership without refund at the Park’s discretion.

12. Learn to Ride Voucher Benefits

a. Each unique member is permitted to use a Learn to Ride voucher only once per calendar year.

b. Learn to Ride voucher benefits are subject to membership tier and must be specified in writing at time of offer to be valid, unless otherwise stated by Nona Adventure Park.

c. All Learn to Ride voucher benefits are subject to the jurisdiction of Nona Adventure Park, and may be terminated at any time due to misuse or fraudulent activity.

d. Misuse of Learn to Ride voucher benefits will result in termination of membership without refund at the Park’s discretion.

13. Governing Law

a. This Agreement is governed by the laws of the State of Florida.

b. Any disputes shall be resolved in the courts of that jurisdiction.

14. Severability

a. If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Indemnification

a. Members agree to indemnify and hold harmless Nona Adventure Park, its owners, directors, officers, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses arising from the actions or omissions of the member or their guests while on park property.

16. Survival

a. All provisions relating to assumption of risk, waivers, releases, indemnification, limitation of liability, and governing law shall survive the suspension, termination, or expiration of membership.

17. Force Majeure

a. Nona Adventure Park shall not be liable for any failure or delay in performance of its obligations, or for any loss, damage, or inconvenience suffered by members, due to events beyond its reasonable control.

b. Such events include, but are not limited to, acts of God, weather conditions, natural disasters, fire, flood, power outages, equipment failure, labor disruptions, governmental orders, public health emergencies, or other circumstances beyond the control of Nona Adventure Park.

18. Precedence of Waiver

a. In the event of any conflict, discrepancy, inconsistency, or confusion between the terms and conditions of this Agreement and the terms of the required liability waiver and assumption of risk (the “Waiver”), the terms of the Waiver shall prevail, govern, and control.

b. To the extent that the Waiver provides for a broader release of liability, indemnification, or assumption of risk than this Agreement, the Waiver shall supersede this Agreement.

19. Acknowledgment

a. By purchasing and using the season pass, the Passholder agrees to the terms and conditions outlined in this Agreement.
